These Terms of Use (“Terms”) govern your access to and use of the SafePlate website and mobile application (the “Service”). By using SafePlate, you agree to these Terms and our Privacy Policy.
1. The Service
SafePlate helps you scan restaurant menus and view estimated guidance for dishes relative to allergens you configure (typically labeled Safe, Ask kitchen, or Avoid). Features, quotas, and pricing may change as we improve the product.
2. Not medical or safety advice
SafePlate is not a medical device and does not provide medical, dietary, or allergy diagnosis advice. Results are automated estimates based on menu text (and similar visible content) plus your self-reported allergen profile. Menus can be incomplete, wrong, or outdated. Kitchens change recipes, share equipment, and use hidden ingredients.
You must always confirm ingredients and preparation with restaurant staff before ordering or eating. If you have a severe allergy or medical condition, consult a qualified professional and use your own judgment. Do not rely solely on SafePlate when a mistake could cause harm.
3. Eligibility
You must be at least 13 years old (or the minimum digital-consent age where you live) to use the Service. If you use SafePlate on behalf of someone else (for example a child), you are responsible for the information you enter and for confirming safety with staff.
4. Your responsibilities
- Provide accurate allergen information and keep it updated.
- Use the Service only for lawful, personal, non-abusive purposes.
- Do not upload illegal content or images you have no right to share.
- Do not attempt to reverse engineer, overload, scrape, or bypass quotas or security.
- Do not use SafePlate to build a competing automated menu-analysis service by abusing our API or scans.
5. Accounts and device data
Core features may work with data stored on your device. If we introduce accounts later, you are responsible for credentials and activity under your account. Notify us of unauthorized access at hello@safeplate.app.
6. Free scans and subscriptions
SafePlate may offer a limited number of free scans and paid subscription plans (for example weekly, monthly, or yearly) that unlock additional scan capacity subject to a weekly cap described in the app.
- Billing. If you subscribe on iOS, payment is charged to your Apple ID through the App Store. On Android, payment is charged through Google Play. Subscription terms, renewals, and cancellations are managed by Apple or Google under their store rules.
- Renewal. Auto-renewable subscriptions renew unless canceled according to the store’s cancellation window (typically at least 24 hours before the period ends on Apple).
- Refunds. Refund requests follow Apple’s or Google’s refund policies for store purchases.
- Quotas. Free and paid scan limits are part of the Service. Unused paid weekly scans do not roll over unless we explicitly say otherwise in the app.
7. Intellectual property
SafePlate, including its name, logo, design, software, and content we create, is owned by us or our licensors. You receive a limited, non-exclusive, non-transferable license to use the Service for personal use in line with these Terms. You keep rights to photos you submit, and you grant us a license to process them solely to provide and improve analysis for your request and to operate the Service.
8. Third-party services
The Service depends on third parties such as Apple, cloud hosting, AI providers, and subscription tooling. Their outages or changes can affect SafePlate. Your use of those platforms may also be governed by their terms.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RESULTS WILL BE ACCURATE, COMPLETE, OR SAFE FOR YOUR ALLERGY OR DIETARY NEEDS.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFEPLATE AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON SCAN RESULTS — INCLUDING ALLERGIC REACTIONS OR OTHER HEALTH OUTCOMES.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE PLACES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT ALLOWED.
11. Indemnity
You agree to indemnify and hold harmless SafePlate and its operator from claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your failure to confirm allergen safety with restaurant staff.
12. Termination
You may stop using SafePlate at any time. We may suspend or stop providing the Service (or your access) if you violate these Terms, if required by law, or if we discontinue the product. Sections that by nature should survive (including disclaimers and liability limits) will survive termination.
13. Changes
We may update these Terms by posting a new version on this page with an updated effective date. Continued use after changes constitutes acceptance. If you do not agree, stop using the Service.
14. Governing law
These Terms are governed by the laws applicable in the operator’s place of residence, without regard to conflict-of-law rules, unless mandatory consumer protections in your country say otherwise. Courts in that jurisdiction will have exclusive venue for disputes that are not resolved informally, except where prohibited.
